The petitioner has been running a Child Care Home with due permission/registration under the Juvenile Justice (Care and Protection of Children) Act, 2000. It is now seeking renewal/issuance of licence under the successor Juvenile Justice (Care and Protection of Children) Act, 2015. The proposal is pending with the respondents since the year 2018. 3.

This Court has dealt with the issue extensively in the matter of Mother Teresa Balakashram Vs. The State of Maharashtra and others in Writ Petition No. 7821/2021 and connected matters decided on 08.09.2022. 4.

Since it is merely a matter of considering the request of the petitioner for having registration under the successor Act, it is expected that the authorities decide the proposal on its own merits obviously by extending an opportunity to the petitioner to rectify the shortcomings. 1/2

The writ petition is disposed of with a direction to the respondents to consider the petitioner's proposal on its own merits and if necessary by extending an opportunity as elaborately dealt with in the matter of Mother Teresa Balakashram (supra). The decision shall be taken within six weeks from today.
