Heard learned counsel for the petitioner.

The present petition is filed for issuance of writ of habeas corpus for production of one Ashiya Mujimil Kureshi with whom the petitioner is having love affair since last three years. 3.

It is contended by the petitioner that the parents and family members of Ashiya are against the relationship and therefore, they confined her at some unknown place. The petitioner has also claimed that Ashiya is having danger to her life from her family members. However, it appears that marriage between the petitioner and Ashiya has not taken place and at present, Ashiya appears to be in the custody of her family members and parents. Besides, she is major and if she feels any danger from her family members, she may lodge complaint in that respect.

Therefore, considering all these facts, we are of the opinion that it is not the fit case to issue writ of habeas corpus in the instant matter. As such, the petition stands dismissed and disposed of. ( Y. G. KHOBRAGADE, J. ) ( SANDIPKUMAR C. MORE J. ) JPChavan
