The petitioner submits that, the petitioner was allotted sand spot, but due to opposition of villagers, the petitioner was not in a position to excavate the sand. The petitioner seeks refund of the amount. The learned counsel submits that, the petitioner had also approached the Collector, Ahmednagar in that regard.

The learned Assistant Government Pleader accepts notice for respondents.

The petitioner may file an application with the Collector, Ahmednagar for refund of the amount. On receipt of the

2 wp 14907.17 application, the Collector, Ahmednagar shall take decision upon its, on its own merits, in accordance with law, expeditiously and preferably within a period of four (04) months from the date of receipt of application.
