It is submitted that, validation proceeding in respect of the tribe claim of the petitioner is still pending. 2.

The learned Assistant Government Pleader on instructions states that, the vigilance is conducted, however, the proceeding is still pending.

Considering the above, we pass following order. 4.

The impugned communication dated 18.11.2017 is quashed and set aside. The respondent No. 2/Committee shall decide the

2 wp 15020.17 validation proceeding in respect of the tribe claim of the petitioner expeditiously and preferably within a period of six (06) months from the date of appearance of the petitioner. The petitioner shall appear before the Committee on 01.03.2018. The respondent/employer shall not take any adverse action against the petitioner only on the ground that validation proceeding is pending. Of course, the respondent/employer is at liberty to take further course action on the basis of judgment that would be delivered by the Committee in validation proceeding.
