Learned counsel for the appellant submits that, learned Reference Court, by observing that in spite of sufficient opportunity, no evidence has been produced by either of the party, passed the impugned order in absence of any oral or documentary evidence. It is therefore submitted that the matter be remanded back. 2.

In view of the above, by way of fair opportunity, the matter is remanded back. It is made clear that in case the the appellant succeeds, he would not be entitled for the interest for the period from dismissal of his claim till today. The First Appeal is accordingly disposed off.
