IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 65 CIVIL APPLICATION NO.6270 OF 2019 IN FAST/39372/2018 VITHOBA RAJARAM MOHITE

VERSUS

THE STATE OF MAHARASHTRA AND ORS ...

Advocate for Applicant : Mr. Ingale Vivekanand V.

AGP for Respondents - State : Mr. B.

V.

Virdhe ...

CORAM : SANDIPKUMAR C. MORE, J.

DATE : 12.12.2022 PER COURT :

Heard rival submissions. The applicant / original appellant is seeking condonation of delay of 2727 days which appears to be caused due to his financial crisis. The learned AGP strongly opposed the application on the ground that there is also circulation delay. The Acquiring Body though served, but remained absent. 2.

Considering the statutory right of the applicant, the delay of 2727 days stands condoned subject to condition that the applicant shall not claim any interest for the aforesaid period of delay as well as the delay in circulating the matter belatedly. 3.

The appeal be placed for admission after removal of office objections, if any.

4.

The application is accordingly disposed of.
