In this case, the appellant, in the memo of appeal itself, has stated that the challenge to the impugned judgment is to the extent it grants excess compensation of Rs.5 lakhs. The appellant has also payed court fee on this basis. In the light of aforesaid, the application for withdrawal is partly allowed and the applicants are permitted to withdraw an amount of Rs.10,69,000/- together with proportionate interest on the said amount.
The application for withdrawal is disposed of in aforesaid terms.
