By order dated 31.10.2023 passed in Writ Petition No.13562/2023, the order suspending the Petitioner dated 16.10.2022, was stayed. The Petitioner was protected from precipitative action. The affidavit undertaking has been tendered by the Petitioner by which he would not be entitled to claim promotion, pay fixation, pay revision, service benefits etc. until his claim is validated by this Court.

The grievance is that the Petitioner is disallowed by Respondent Nos.2 and 3-BSNL from reporting for duties.

Heard the learned advocates for the respective sides. Perused the record and the order passed by this Court.

In view of the above, the Civil Application is allowed. The Petitioner shall join the duties on 11.12.2023 at the place / location where he was working at the time of his suspension.
