The learned counsel for the petitioner submits that the show cause notice is issued for unauthorizedly carrying Murun (minor mineral) and that the vehicle of the petitioner is detained on 20.10.2023. The show notice is issued for carrying illegally minor mineral on 26.10.2023. The learned counsel submits that he has filed reply on 31.10.2023 along with necessary documents to the said notice, however, no action has been taken by the concerned Tahsildar.

The learned AGP submits that the Tahsildar would decide the pending show cause notice expeditiously.

The learned counsel for the petitioner submits that since the matter is pending, considering the reply filed by the petitioner, the final order be passed, quashing the notice dated 26.10.2023 in view of the fact that he has valid pass and that the royalty is also paid on the same, which is reflected from the documents annexed to the petition.

However, instead of this court exercising of the writ jurisdiction, it is appropriate to direct the Tahsildar to decide the show cause notice dated 26.10.023 within a period of one (01) week, in accordance with law and considering the reply filed by the petition.

The learned AGP to intimate to the concerned Tahsildar to decide the show cause notice within a period of one (01) from today.

The writ petition stands disposed of.
