This application, filed under section 439 (2) of the Code of Criminal Procedure seeks cancellation of anticipatory bail granted to the respondents/accused by the Sessions Court vide order dated 08/11/2019 in Crime No. 287 of 2019 registered with Nandurbar Police Station for the offences punishable under sections 377, 393, 344, 452, 498-A, 323, 504, 506 read with 34 of the Indian Penal Code. 2.

Heard the learned advocate for the applicant and the learned Additional Public Prosecutor for respondent No.8 - State.

Learned Additional Public Prosecutor, during the course of argument has pointed out that all the accused in the present crime had moved application No. 411 of 2020 for quashing of FIR, which was allowed to the extent of accused Nos. 5 to 7 vide order dated 04/10/2021.

Subsequently, charge-sheet came to be filed and the case is numbered as Sessions Case No.5 of 2020, and after recording evidence, all the accused persons were acquitted in the said case by Judgment and order dated 29/11/2022. 5.

In view of the aforesaid circumstances, the present application is rendered infructuous and the same is disposed of as infructuous.
