Present application has been filed for getting delay of 178 days condoned caused in filing the second appeal.

Learned Advocate/s for the respondents strongly opposed the application.

The applicant is an agriculturist, was facing multiple ailments and undergone the medical treatment and, therefore, could not approach this Court within time. Taking into consideration the reasons set out in the application, the delay deserves to be condoned. However, the inconvenience that would be caused to the respondents, deserves to be compensated in terms of money. Hence, the delay stands condoned subject to deposit of Rs.5,000/-

(2) within a period of one month from today. After the amount is deposited, it be paid to the respondents. The application stands allowed and disposed of.
