Applicant seeks to condone delay of 1279 days caused in filing application for setting aside abatement and bringing legal heirs of the deceased Ranubai Shiva Jadhav on record. 2.

The cause of action survives as against the legal heirs of the deceased Ranubai. The delay is unintentional. There is no serious challenge by the respondents to the application. The civil application is allowed in terms of prayer clause B to D. The civil application is disposed of.
