The petitioner's claim for sanctioning of additional teaching staff has been turned down on the ground of infrastructural deficiency. 3.

According to learned Advocate for the petitioner, the Education Officer paid visit to the school during Covid-19 Pandemic. Notice of inspection was not given to representative of petitioner/School. According to him, there was an upper premises wherein, additional classes were held. Everything went unnoticed. According to him, the inspection report is therefore, strongly disputed. 4.

During the course of hearing, learned Advocate for the petitioner comes around to submit that if the school premises are reinspected and fresh report is submitted and if the authorities concerned are ready to

2 926.doc decide the petitioner's claim afresh, the matter may be disposed of. 5.

The learned A.G.P is at one with the submissions advanced by the learned Advocate for the petitioner.

In view of the above, the Writ Petition is disposed of in terms of the following order :

ORDER

i) The Education Officer, (Primary), Nanded shall visit the school premises and verify the infrastructure available and other necessary documents for grant of the petitioner's claim. On such visit, having been made in the presence of representative of the petitioner/school, the Education Officer, (Primary), Dist. Nanded shall decide the petitioner's claim afresh on its own merits.
