This is an application seeking condonation of delay of 393 days caused in filing appeal under Section 30 of the Employees Compensation Act, 1923. The applicant has suffered facial injuries and injuries on lower limbs on account of the accident. The learned Compensation Commissioner has rejected the claim in its entirety. The applicant has stated on oath that the appeal could not be preferred within the prescribed period of limitation due to serious financial constraints.

Having regard to the reasons mentioned in the application which are supported by affirmation, I am inclined to condone the delay caused in filing appeal. Civil Application is allowed and delay of 393 days is condoned.

Civil Application is disposed of.

Put up First Appeal on 02.04.2025 for hearing at the admission stage.
