15.1.2018 PER COURT:- 1) This application, which is made by the legal representatives of the respondents in the First Appeal is infact mis-conceived. The appellant ought to have taken out such application to bring on record the applicants, who claimed to be legal representatives of the deceased respondent. However, now when such application has been taken out, the abatement if any is set aside.
( 2 ) 34 CA 169 of 2018 2) The appellants are directed to bring on record the applicants as legal representatives of deceased respondent. Necessary amendment be carried out within four weeks from today.
3) Mr.S.N.Patil learned counsel, who holds for Mr.Gajanan K.Sontakke learned counsel, waives service of notice on behalf of the legal representatives, who are now ordered to be brought on record.
4) The Civil Application is disposed of in the aforesaid terms.
