Mr Shinde, learned Counsel for the petitioner submits that the petitioner was not allowed to excavate the sand in view of the order passed by the National Green Tribunal. The petitioner applied for refund of the amount, however, the same is not yet considered by the authority.

Learned A.G.P. accepts notice for both the respondents. 4.

In case the application filed by the petitioner for refund of amount (Page 31 and 32) is pending with respondent no.2, then respondent no.2 shall take decision upon it on its own merits, as early as possible, preferably within a period of six months. 5.

Writ Petition stands disposed of. No costs.
