This is an application for bringing on record legal heirs of sole appellant and for condonation of delay of 4654 days occurred in preferring the application.

Learned counsel for the applicants states that for want of knowledge of the proceeding fled by the father of the applicants i.e. the sole appellant, steps could not be taken to bring themselves on record. On instructions, he makes a statement that the applicants

- 2 - ca3426.20.odt will not claim interest for 4654 days in the event they succeed in getting enhanced compensation in the appeal.

Since the applicants have waived interest on the enhanced compensation for the period of delay, no prejudice will cause to the respondents if delay is condoned. In the result, application stands allowed in terms of prayer clauses 'B' and 'C'. Delay caused in fling the application stands condoned. Legal heirs of deceased appellant be brought on record. Amendment be carried out within two weeks. Civil application stands disposed of. ( R. M. JOSHI) Judge dyb
