The applicant/appellant, who is original plaintiff, has filed this application to allow him to bring on record legal representatives of respondent No.1 (original defendant), who died on 24.10.2019. 2.

Heard Mr.Indraneel S. Godsay h/f. Mr. Deshpande, learned counsel appearing for the applicant and learned counsel Mr.T.G. Gaikwad for respondent No.8. It is submitted that respondent No.1 died on 24.10.2019 and this application is moved on 09.12.2019. It is further submitted that as application is in time, the applicant be allowed to bring on record legal representatives of respondent No.1 mentioned in paragraph 2 of the application.

Considering the submissions made by learned counsel appearing for the applicant, the application is allowed in terms of prayer clause (B). Necessary amendment to show legal representatives of respondent No.1 in cause title, be made within two weeks. 4.

After amendment, issue notice to legal representatives of respondent No.1, returnable on 12.02.2020.
