Versus

Ramesh Bimrao Jadhav & Anr.

...Respondents

*** Mr. Shaikh Mazhar A. Jahagirdar, Advocate for the Applicants. *** CORAM : ABHAY J. MANTRI, J.

DATE : DECEMBER 22, 2025 PER COURT :

1.

The applicants, who are the original claimants, have moved the present application seeking permission to withdraw the compensation amount deposited by respondent No.2 - Insurance Company in this Court. 2.

On perusal of the record, it appears that by order dated 17th October 2025, First Appeal No. 2775 of 2021 has been dismissed. Therefore, in my view, permitting the claimants to withdraw the amount deposited by respondent No.2 - Insurance Company would not prejudice the rights of any of the parties.

3.

Accordingly, the application is allowed. The applicants are permitted to withdraw the amount deposited by respondent No.2 - Insurance Company, along with accrued interest thereon. Shrikant Malani

20.CA.14053.2025.odt 4.

The Registrar (Judicial) is directed to transmit the amount deposited by respondent No.2 - Insurance Company, along with accrued interest thereon, to the bank accounts of the claimants in proportion as apportioned, determined by the learned Tribunal, Newasa. The share of applicant Nos. 2 and 3 shall be kept in a fixed deposit in any nationalised bank until they attain the age of majority.
