Considering the above, the Civil Application is allowed. Issue notice to the respondent No.1, returnable on 02.02.2018.

The applicant-original appellant shall have the notice published in Gujarathi daily newspaper "Divya Bhaskar", Surat edition at his own cost and at least two weeks prior to the returnable date.
