The original Petitioner- Dnyanoba s/o Santram Salve, who was working on the post of Daftar Karkoon with the Respondent No.5- Jaikwadi Irrigation Division No.2, Parbhani, has claimed deemed date of promotion on the said post from 1/1/1969 with consequential benefits.

Learned Advocate for the Petitioners took us through the papers on record. From the papers on record, it is seen that, the claim/ proposal of the deceased Petitioner Dnyanoba Santram Salve was referred by the office of respondent No.3- Superintending Engineer, Aurangabad Irrigation Circle, Aurangabad to the Government in the respondent No.1 Department. The said communication is dated 23/3/2009. There is one communication dated 23/10/2015 by the General Administration Department, Mantralaya, Mumbai addressed to the deceased Petitioner, that the representation/ letter was forwarded to the Respondent No.1 Department, being Administrative Department of the office in which the deceased Petitioner was working. From these papers on record, it is seen that the proposal of the deceased Petitioner is still pending with the Respondent No.1 Department. The limited relief claimed in the Petition is directions to the concerned authority to consider the claim.

In view of the above, we direct the Respondent No.1 to consider and decide the claim of the deceased

Petitioner Dnyanoba Santram Salve, which is pending with them, if not already decided, on its own merits and in accordance with law, to be decided within a period of three months from the date of receipt of this order. Writ Petition stands disposed of.
