Mr Thombre, the learned counsel for the petitioner submits that, the petitioner had applied for B.Sc. Para Medical Technology (Cardiology) as a first preference but the petitioner was allotted Operation Theatre. The petitioner had given the preference for Cardiology, the said preference ought to have been considered by the respondents. The petitioner on 14.11.2017 filed an application with respondent No. 3 to consider his request to change the subject from Operation Theatre to Cardiology. The seat for the said subject was also vacant, however, the said request is not considered by the respondents.

The learned AGP submits that, there were five seats meant for B.Sc. (Cardiology). The students selected for B.Sc. Cardiology are having more marks than the present petitioner. 3.

We have perused the affidavit filed by the respondents. It is stated that, there were five seats for Cardiology. Four seats are meant for general category and one for women category. Out of general category, one seat is reserved for ST category and one for OBC and two for open competition and one seat is reserved for OBC category for women. The petitioner is having less marks. The students selected from OBC category have secured 65.08% and 60% in HSC, whereas; the petitioner has secured 50.01% marks. 4.
