1] Heard learned counsel for the applicant and learned counsel for contesting respondent Nos. 1 and 6. Rest of the respondents did not turn up to tihs court when the matter is called out.

2] The present application is filed seeking permission to delete respondent No.9 - Amrutlal Ramgopal Sharma from the array of respondents as he is no more and died on 10.9.2017.

3] In view of nature of subject matter there is no impediment to allow the applicants to delete the name of respondent No.9 as he is no more. The deletion of respondent No.9 from the array of respondents is without prejudice to the rights and interest of other respondents. Accordingly, the civil application stands allowed in terms of prayer (B) and same is disposed of. Amendment be carried out within two weeks.
