Applicants apprehend arrest in C.R. No. 431 of 2023, registered with New Mondha Police Station, Dist. Parbhani, for offences punishable under sections 353, 435, 427, 143, 147, 149 of Indian Penal Code.

FIR is lodged by Purbha Kale alleging that since 2013 he is serving as Registrar in Vasantrao Naik Agricultural University at Head Office, Parbhani. He has been provided a Government vehicle bearing No. MH-22-AM-4432. One Javed Ali Khan is a driver on the said Government vehicle. On 30.10.2023, he went to his house for lunch. When informant was about to return to the office, his driver Javed Ali Khan came making hue and cry saying that somebody set ablaze his official car. When informant asked him what happened, Javed Ali Khan informed that four unknown persons, had covered their faces by handkerchiefs over their mouths, came and threatened to kill him if he did not alight from the car. When he alighted from the car, they gave a slogan, "Maratha Arakshan Amche Hakkache, Nahi Konachya Bapache" and set ablaze the car by pouring petrol, which was brought by them in a bottle and also broken front glass of car by pelting stone and caused damage to the car to the tune of Rs. 6,00,000/-.

Heard learned advocates for applicants and learned APP for State. Perused the investigation papers. 4.

From the investigation papers it appears that names of applicants are disclosed by co-accused. Except that there does

{3} not appear any material connecting applicants to the present crime. Nothing is to be recovered from applicants, hence, their pre-trial custodial detention is not necessary. 5.

Applications are therefore allowed by confirming interim protection order dated 20th December, 2023 and 18th December, 2023, respectively.

Till filing of charge sheet, applicants shall attend the concerned police station as and when called by investigating officer and shall co-operate in the investigation. Applicants shall not tamper the prosecution evidence.
