Mr. Deshmukh, learned Advocate, appears for respondent Nos. 2 and 3 and places the copy of email by respondent Nos. 2 and 3 which states that Plot No. 26, Growth Centre - 1 Golwadi Nagar 4 has been deleted from e-auction. The letter is taken on record by marking Exhibit 'X'.

Learned Advocate for the petitioner submits that the petitioner was allotted with the said plot by respondent No. 2. However, it was canceled by communication dated 12.04.2023, on the ground of non payment of first installment before due date. Since now, when the said plot which was then put to e-auction has been deleted, purpose behind the petition is served. The only question is that respondent 927-WP-15563-2025.odt

should accept second installment from the petitioner. 3.

Here, it is to be noted that since a statement has been made that plot No. 26 has been deleted from e-auction and the purpose of the petition has been served, we dispose of the writ petition. However, we cannot compel respondent Nos. 2 and 3 to receive the second installment. If the right survives in favour of the petitioner then respondent Nos. 2 and 3 may consider and accept the second installment.
