Learned Additional Government Pleader has placed on record the communication received from Director, Medical Education and Research, Mumbai. In the said communication it is stated in paragraphs 5 and 7 as under- "5. The State Government will nominate appropriate, qualified, eligible person for the post of President. The said nomination is not related to donation or space allocation to the council. The nomination will be strictly on the basis of merit.

The Government will nominate appropriate, qualified, eligible person as the 1st President for the council."

In view of the same, the grievance of the petitioner stands meted out.
