IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 1263 OF 2018 RAM DNYANOBA BEMBDE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS Mr.Vijay B. Patil, Advocate for the petitioner Mr.S.S.Dande, AGP for the respondent/State CORAM : S.S. SHINDE & S.M.GAVHANE, JJ.

DATED :

01.02.2018 P.C. :- .

The grievance raised in this petition is that though the directions are issued by the District Social Welfare Office, Zilla Parishad, Latur to the Headmaster i.e. respondent No.6 by letter dated 04.10.2017 [Exh.F page 30], those directions are not being followed by respondent No.6.

2.

In our opinion for the said purpose and the relief sought in this petition, the petitioner can approach the District Social Welfare Office, Zilla Parishad, Latur, so as to ensure that his directions are followed by the respondents in letter and spirit. In the light of above, we decline to entertain this writ petition, however we grant liberty to the petitioner to

( 2 ) wp1263.18 approach respondent No.4 to take appropriate steps for implementation of directions issued by him to respondent No.6, in case petitioner approaches the respondent No.4. Needless to observe that, if the directions given by respondent No.4 contained in the letter dated 04.10.2017 written to the respondent No.6 are legally sustainable, respondent No.4 would be at liberty to take appropriate steps against respondent No.6 including not to disburse the further grants to said school.

3.

With the above observations, the writ petition stands disposed of.
