This application is moved by the learned counsel for the applicant for seeking direction office to accept the cheque. 3.

According to Mr. Anand Dale, learned counsel holding for Advocate M. K. Goyanka for the applicant/respondent no. 2 in appeal - Insurance Company was supposed to deposit remaining amount of Rs. 1,00,000/- to the minor claimant. However, respondent No. 3 was minor at the relevant time and it was directed that the amount falling to her share be deposited in any Nationalized Bank, however, the said cheque was handed over to the claimant who is an illiterate lady and

ca-13985/25 she was not having any knowledge regarding to deposit the same. Therefore the said cheque never deposited in the registry. The said mistake came to be realized in the month of September-2025 therefore the Insurance Company issued fresh cheque dated 29.09.2025. However, in absence of specific order of this Court registry is not accepting the said cheque.

Mr..Dale, learned counsel holding for Mr. Goyanka submits that the cheque dated 29.09.2025 is going to expire on 29.12.2025. Therefore, same may be permitted to deposit the same with the Registry.

In that view of the matter registry to accept the cheque as prayed for.

Cheque bearing No.365357 dated 29.09.2025 of Rs.61,000/- be accepted.
