Rule made returnable forth with. Heard finally by consent. The limited grievance of the petitioners is that the Additional Divisional Commissioner, Aurangabad has stayed the order of disqualification passed by respondent No.2 as regards respondent No.5.

I have heard the learned counsel for the petitioner, the learned AGP and the learned counsel who appears on caveat for respondent No.5.

Perusal of the concluding paragraph of the order impugned reveals that the Additional Divisional Commissioner has given

{2} wp 286.20.odt sufficient reasons for exercising discretion in favour of respondent No.5.

Considering that the order is an interim order, interests of justice would be sub-served if the Additional Divisional Commissioner is directed to finally decide the appeal, as expeditiously as possible and in any event within 30 days from the conclusion of the hearing.

It is stated at the bar that the appeal is fixed for hearing on 5.2.2020. No adjournment shall be granted by the Additional Divisional Commissioner on the said date and the parties shall be heard. The order shall be passed within next 30 days. Rule is made absolute accordingly.
