The learned advocate for the respondents relies upon a recent judgment dated 08.11.2019 delivered by this Court in Writ Petition No. 13454/2019 in the matter of Dhanraj s/o Bhaurao Gaikwad Vs. The Divisional Controller, MSRTC and another. He also places on record the copy of the order of punishment dated 13.12.2019 issued to the petitioner by which, he has been dismissed from service.

The learned advocate for the petitioner submits that he

- 2 - has been instructed by the petitioner, who is present in the Court, to withdraw this petition so as to challenge the dismissal order dated 13.12.2019.

In view of the above, this petition is disposed off as withdrawn with liberty to the petitioner to challenge the dismissal order. All contentions of the litigating sides in the said litigation are kept open.
