After hearing both sides, when this Court expressed disinclination to allow the application, learned advocate for the applicant, on instructions, seeks leave to withdraw this application. 2.

Leave granted. The application is disposed of as withdrawn.

During the course of arguments, learned advocate for the applicant submits that the applicant's wife and daughter are depending upon him and they have no source of income. 4.

Considering the facts and circumstances of the case, it appears that though the applicant has committed the offence, the wife of the applicant viz. Heena w/o Shaikh Vajir and daughter viz. Aashmira d/o Shaikh Vajir, are also victims of the crime. Therefore, it

ba2290.23 -2would be proper to direct the Secretary, District Legal Services Authority, Aurangabad to provide them monetary relief, particularly to file an application on behalf of the wife and daughter of the applicant to the Tahsildar, Aurangabad for granting them monthly amount under the schemes like Shravan Bal Yojna and Eklavya Yojna etc. so that they will get financial support.

The Tahsildar, Aurangabad is also directed to get all formalities completed from the wife and daughter of the applicant and grant them monthly allowance, as directed above. 6.

Registry to forward the copies of this order to the Tahsildar, Aurangabad, so also to the Secretary, District Legal Services Authority, Aurangabad, as early as possible. (SANJAY A. DESHMUKH, J.) rlj/
