It seems that, as a result of failure to take steps regarding unserved respondent no.5 within the stipulated period, the conditional order dated 04.10.2019 came into operation and the First Appeal stood rejected on 08.11.2019. Even subsequent Civil Application No. 3318 of 2020 and Civil Application No. 3912 of 2020, praying issuance of notice to respondent no.5 on fresh address and seeking restoration of the First Appeal, respectively, remained unattained due to wrong nomenclature, outbreak of Covid etc.

Now, Civil Application No. 5080 of 2025 is filed seeking condonation of delay of 1916 days in preferring the same and restoration of the First Appeal as well as issuance of notice to respondent no.5 on the fresh address given in paragraph no. 2 of Civil Application No. 3318 of 2020.

For the reasons mentioned in Civil Application No. 5080 of 2025, and since learned counsel for the respondents has no objection, the same is allowed in terms of prayer clauses "B" and "C". 5.
