An auction notice dated 28.12.2023 is sought to be assailed before us by filing this Writ Petition. The total liability on the Petitioner, as on 04.09.2020, is Rs.7,90,55,004/-. The auction is scheduled on 28.12.2023. A proceeding is already pending before the Debts Recovery Tribunal at Aurangabad.

In view of the above, we are not inclined to entertain this petition since a statutory remedy has already been availed of. If any adverse orders are passed, the Petitioner has the remedy of approaching the Debts Recovery Appellate Tribunal.
