The applicant has approached this Court seeking regular bail in connection with FIR dated 30.11.2025 bearing Crime No. 0474 of 2025 registered with Mukundwadi Police Station, District - Chhatrapati Sambhajinagar for the offences punishable under section 20(b) and 8(c) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985.

Issue notice to respondent. The learned APP waives service on behalf of respondent-State.

The prosecution's case is that on 29.11.2025 at about 20:31 hours, the informant received secret information that, one person will come at Zenda chowk for selling Ganja. On 30.11.2025 at about 00:27 hours, the informant and others reached the spot

-2and noticed the applicant. The police asked him to stop. The applicant was having a travel bag in his hand. On inspection of the travel bag, five bundles were found. The bundles were weighed to 10 kg. 216 grams. The officers of F.S.L. tested the substance and found it to be Ganja. Therefore, informant lodged the report. 4.

The learned counsel for the applicant submits that the bail is sought before the Trial Court on the ground of examination of the applicant which is commencing from 15.12.2025 and ending on 24.12.2025. Accordingly, the Trial Court granted the temporary bail to the applicant, however, till 25.12.2025. The learned counsel for applicant submits that the initial schedule of the examination is deferred and now, the same is rescheduled on 27.12.2025. As such, prayed to allow the application.

Learned APP has opposed the application submitting that the applicant is indulged into serious offence. If the applicant is enlarged on bail, there is every possibility of repetition of offence. As such, prayed to reject the application. 6.

Upon considering the submissions of both sides and perusing the material on record, it is prima facie evident that the applicant is a student of the Sinhgad Institute of Technology, Pune, studying in S.E. Mechanical Engineering. In view of the matter, and

-3considering the young age of the applicant and the fact that his examinations have been rescheduled on 27.12.2025, I am of the considered view that the applicant should be enlarged on temporary bail until the conclusion of his examinations. Hence, I pass the following order.

Resultantly, the following order is passed :-

ORDER

(I) Application is partly allowed.

(II) The applicant, Kishor Ganesh Sangle, be temporarily released on bail till 29.12.2025, in connection with C.R.No.474/2025, registered with Mukundwadi Police Station, Aurangabad, for the offence punishable under Sections 20(b) and 8(c) of N.D.P.S. Act, on his executing P.B. of Rs.50,000/- with surety of the like amount on following conditions;

(a) The applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with facts of the case, so as to dissuade him from disclosing such a facts to the Court or to any police officer.

(b) The applicant shall surrender before the Jail Authority on 29.12.2025.
