Learned counsel for the Caveator / respondent No.1 submits that his son, who is original plaintiff in RCS No.310 of 2014, has withdrawn the said suit, under order dated 22.1.2018. As such, this petition, challenging the rejection of application Exhibit 22, praying for staying RCS No.236 of 2017 filed by respondent No.1, under Section 10 of the CPC is rendered infructuous.

Learned counsel for the petitioner submits that this petition can, therefore, be disposed off as being infructuous. 3.
