We have heard Mr. Choukidar, learned counsel for the petitioners, Mr. Bhagat, learned A.G.P. for respondent nos. 1 to 4 and Mr. Bhavthankar learned counsel for respondent nos. 5 to 8.

The Education Officer has filed affidavit. Paragraph no. 8 of the affidavit reads thus - "....

I say and submit that, if the Respondent no. 5 submit the proposal of Petitioner's son as junior clerk's transfer, the office of the Respondent no. 4 will be in a position to
2 wp 15291.17 grant retrospective approval and the payment and salary will be paid according to the rules."

Mr. Bhavthankar, learned counsel appears for respondent nos. 5 to 8 and submits that the proposal would be submitted within two weeks. 4.
Respondent no. 5 shall submit the salary bills due and payable to the deceased son of the petitioners to the Education Officer and the Education Officer shall process the same as may be admissible under the rules and also the proposal with regard to pension and retiral benefits for the post of Junior Clerk. Upon receipt of the proposal the Education Officer shall process the same and take decision within eight (8) weeks from the date of receipt of the proposal.

Writ Petition accordingly stands disposed of. No costs.
