The learned Advocate for the applicants seeks leave to withdraw the application on instructions from the applicants, in view of the fact that notice of concurrence is not issued and as such the application suffers from a technical defect.

Permission is granted to withdraw the application with liberty to file fresh application after issuing notice of concurrence. 3.

It will be open for the applicants to contend that the period spent from issuance of notice dated 03.11.2023 which was purportedly issued as per Section 11 of the Arbitration and Conciliation Act, 1996 till 21.08.2025 i.e. date of disposal of the present application be excluded for the purpose of computation of limitation in view of Section 14 of the Limitation Act, 1963.
