2.2.2018 PER COURT:- 1) Since the Appeal from Order is not maintainable against the impugned order, the learned counsel for the appellant seeks to withdraw this Appeal from Order with liberty to institute a petition under Article 227 of Constitution of India. He however, submits that last date for compliance of conditions imposed in the impugned order is 5.2.2018 and therefore, by way indulgence prays for extension of two weeks time to comply with the condition as regards deposit of the interest component only.
2) The request is reasonable in the circumstances of
( 2 ) AO 14 of 2018 the case and hence request is accepted.
3) Accordingly, if the appellant deposits the principal amount of Rs.3,61,478/- before the Labour Court on or before 5.2.2018, as directed in the impugned order, the time limit for deposit of the interest component to stand extended by a period of two weeks from the said date. 4) Leave is granted to withdraw this appeal with liberty as prayed.
5) It is made clear that extension of two weeks time is not granted on merits, but purely by way of indulgence. 6) Appeal from Order is disposed of.
7) All the concerned to act on the authenticated copy of this Order.
