PER COURT :- So far as regards prayer for direction to register F.I.R. is concerned, based on the report lodged by the applicant, F.I.R. was registered. The charge sheet has been filed.

To seek further investigation, the applicant may approach the court concerned in view of observations of the Apex Court in the case of Sakiri Vasu vs. State of Uttar Pradesh and others, (2008) 2 SCC 409.

The further prayer pertains to grant of police protection with a view to protect the applicant's possession is concerned, since the civil suit is pending between the parties, no such directions could be issued. The applicant may be at liberty to approach the concerned civil court with appropriate application. If such application is preferred, the same would be decided on its own merits.
