Learned Counsel for the petitioner submitted that as the petitioner was under a bona fide impression, he approached this Court. He further submits that as the petitioner has to further file application seeking condonation of delay, the authority be directed to consider that the application on the backdrop of the fact that the petitioner had approached this Court by way of present writ petition.

The petitioner is permitted to file application before the appellate authority seeking condonation of delay and if such application is filed, the appellate authority to consider the fact of filing petition before this Court and decide the application.
