Learned APP seeks leave to amend the application in view of the fact that the respondent - original accused stood prosecuted for the offence punishable under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act also. In view of Section 14-A(3) of the Atrocities Act the appeal should have been filed and not an application under Section 378(1) (b) of the Code of Criminal Procedure.

Leave is granted.

Amendment to be carried out forthwith.
