By this application applicant Nos. 1 and 3 to 9, who are impleaded as the respondents in this appeal, seek condonation of delay in bringing themselves on record as the legal representatives of Smt. Gayabvai w/o Ganpati Jadhav the deceased respondent No. 2 (Claimant). 2.

The original reference was made by Ganpati Jadhav and applicant No. 1 to 9, including Gayabai, were impleaded as the legal representatives of deceased Ganpati.

It is averred that applicant Nos. 1 and 3 to 9 are the legal representatives of Smt. Gayabai. Since the estate of Smt. Gayabai is represented by applicant Nos. 1 and 3 to 9, there is no question of

44ca1356.20 abatement. Hence the application stands allowed in terms of prayer Clause 'B' and 'C'.
