Applicant is wife. She claims to be unemployed. She has responsibility of four years old child. It is, therefore, her contention that it is inconvenient for her to travel from Parbhani to Latur which is at the distance of 150 km. On this ground, transfer of Marriage Petition No. A-130/2019 filed at Family Court, Latur is sought to be transferred to Family Court, Parbhani.

Though Respondent is duly served, remained absent. His absence shows that he is not interested in opposing application.

The contention of the Applicant has gone un-

939-MCA-13-2020.odt controverted. Applicant was able to show that it is inconvenient for her to travel from Latur to Parbhani. Compelling her to attend Marriage Petition No. A130/2019 at Latur will affect her right to defend effectively.

In view of above, application stands allowed in terms of prayer clause 'B'. Marriage Petition No. A130/2019 is transferred from Latur to Parbhani. Family Court, Parbhani to issue notice to Respondent as this order is passed in his absence.
