The contention of the Petitioner is that a Writ of Mandamus should be issued to the Education Officer to continue the Petitioner as an Incharge Headmaster of a Secondary and Higher Secondary Ashram School. 2.

It does not call for any debate that no Incharge person can claim a right to the post. In view of this position, we do not desire to issue a Writ of Mandamus. We leave it to Respondent No.3 to deal with the said aspect strictly in accordance with rules and the policies applicable . 3.

The learned advocate for the Petitioner submits that the Management is threatening him to hand over the charge of the officiating

( 2 ) 948 wp 112.24 Headmaster. We leave it open to the Petitioner to deal with such threats as is permissible in law.
