The petitioner has filed the present Writ Petition seeking appointment from Project Affected Persons category and also challenging the order dated 02.12.2017 holding that the petitioner is not entitled to be considered for Project Affected Persons category. 2.

The dispute appears to be about the land being acquired of a person who has nominated the petitioner. The petitioner is the son of Babanrao Khating. It is submitted that Project Affected Persons certificate exists in the name of Babanrao Khating.

The petitioner shall produce on record partition decree relied upon by him and complete genealogy showing relations of each other qua the properties acquired, so also the notice received by the respective parties under Section 12 (2) of the Land Acquisition Act, to justify that individual payments were made in respect of their lands. Upon furnishing all these documents the respondentsAuthority shall take decision afresh with regard to the claim of the petitioner for appointment of Project Affected Persons category. 5.

The claim of the petitioner shall be considered qua their property acquired.

With these directions, the Writ Petition is disposed of. No costs.
