When this Court expressed its disinclination to allow the application, the learned advocate for the applicant, on instructions, seeks leave to withdraw the application. Leave granted. The application is disposed of as withdrawn.

The learned advocate for the applicant further submits that trial be concluded and can be concluded within three months. 4.

The learned APP submits that the ballistic report is not received.

Considering the facts and circumstances of the case, the prayer of the applicant's advocate deserves to be allowed. The learned trial Court is directed to decide the Sessions Case No.76 of 2023 within three months from today. At the same time, the office of ballistic expert is directed to submit the ballistic report as early as

2336.2023BA -2possible however within one month. Investigating Officer is directed to visit that office along with the copy of this order and get ballistic report and submit it in the Sessions Case No.76 of 2023. 6.

The Sessions Court is directed to conclude the trial in the literal sense of word session. Needless to mention, the session means, once it started, it shall not be stopped till it is concluded. 7.

If the trial is not concluded within four months, the applicant is at liberty to file the application for granting bail before the trial Court.
