We have considered the submissions of the learned Senior Advocate along with the learned Advocate Shri V. R. Dhorde and the prayers below paragraph No.19. We expressed our disinclination with regard to the prayer as regards registering of an offence, the learned Advocate on record submits on instructions that the Petitioner would not press prayer clause (D). 2.

A proposed amendment is placed on record in this Petition to indicate that the Petitioner Vaibhav Dhanraj Chate had earlier filed Writ Petition No.4918/2023, which fact was suppressed from the learned Advocate on record, who has drafted

15706.23wp (2) and filed this Petition. The said proposed amendment is taken on record and marked as 'X-1' for identification. Leave to amend is granted. Amendment be carried out forthwith. 3.

The learned Senior Advocate submits that the Petitioner would approach the Court in Writ Petition No.4918/2023, for relief as against the blacklisting order dated 16/12/2020, passed by the Collector, Beed. He, therefore, submits that this Petition can be disposed off. He further prays that, if the F.I.R. is registered, liberty to the Petitioner may be kept open to initiate appropriate proceedings against the F.I.R. for seeking quashing/discharge, etc.

In view of the above, this Writ Petition is disposed off, by relying on the statements recorded above on instructions. Liberty as prayed for, is available to the Petitioner under the Code of Criminal Procedure.
