Since, the application for consolidation of three suits is filed in one of the Civil Suits and parties in other two Civil Suits are not before this Court, this Court is not inclined to entertain this petition although it appears that there is some substance in the contentions raised by the petitioners on merits of the matter.

In view of the above, permission is granted to withdraw the petition with liberty to file fresh application for consolidation of Special Civil Suit No.71 of 2013, Regular Civil Suit No.110 of 2011 and Regular Civil Suit No.318 of 2022, pending on the file of the learned Civil Judge, Senior Division,

971-wp-1099-2024 Jalgaon. If any such application is filed, the same be considered in the light of paragraph no.7 of the judgment dated 10.07.2023, passed by the learned Principal District Judge, Jalgaon in Miscellaneous Civil Application No.04 of 2023.

The learned Trial Court shall not be influenced by the observations made in the impugned order.
