Heard learned counsel for the applicants and learned AGP for respondent No.1. It appears that original claimant had fled proceeding of L.A.R.No.188 of 2001 under Section 18 of the Land Acquisition Act, 1894 for enhancement of the compensation amount. Learned Reference Court partly allowed the aforesaid LAR. The present applicants are legal heirs of original claimant deceased Shaikh Chand Sk. Mehboob Pinjari. They produced death certifcate. They also produced legal heir-ship certifcate issued by the Civil Court, Junior Division, Jalgaon. The applicants are seeking permission to allow them to pursue the matter by fling First Appeal accompanied with civil application for condonation of delay, being legal heirs of deceased Shaikh Chand Sk. Mehboob Pinjari. In view of attending circumstances on record, there is no impediment to allow the application.

Accordingly application stands allowed in terms of prayer clauses-'B' and 'C'. The applicants are hereby permitted to proceed further by fling an appeal and application for condonation of delay being legal heirs of deceased Shaikh Chand Sk. Mehboob Pinjari.
