Smt. Rani Bhosle, the Superintendent of Yerwada, Central Prison, Pune-6 by communication dated 20.9.2021 informed to this Court that the appellant/convict (C-17959) Dada Maruti Gite died in J.J. Hospital, Mumbai on 6.5.2021 at about 1.21 am. Even, the Superintendent of Yerwada Central Prison Pune has annexed information sheet for custodial death case reported to N.H.R.C. and also the custodial report in prescribed proforma I.

In view of the above, the appeal stands abated and disposed of accordingly.

Since Mr. S N Rodge, the learned counsel is appointed to represent the cause of the appellant, we quantify his legal fees and expenses to the tune of Rs.3,000/- (Rs. Three Thousand) to be paid by the High Court Legal Services Sub-committee, Aurangabad. 4.

Criminal Application ALS No.230 of 2018 is adjourned to 26.11.2021.
